Landowners Against Transcanada Pipeline


Yesterday, the US ARMY CORP OF ENGINEERS filed an emergency motion today asking the United States District Court, Eastern District of Texas  to vacate the entry of default on claims the agency wasn’t properly notified of the lawsuit.

"The United States Attorney General has filed a motion to vacate the entry of default which was entered by the Clerk of the Federal Court, Eastern District of Texas.  This is not a surprise and given my experience with lawyers this last two years, completely expected.  What is sad is that once again, the government is ignoring the very people that pay their salaries, the ones that elected them and are stonewalling the only recourse the public has left;  the court system. I served notice as per the written and documented instructions of the United States District Court, Eastern District of Texas.   I hired a third party professional process server to serve the government and in the end, this default will stand up to scrutiny by the judge.  The government dropped the ball, plain and simple.  The public needs to know that even if a final judgment is rendered, the Defendants can file for other motions and even appeal.  This is the point where public pressure needs to be brought on the White House and our elected officials.  Justice for landowners in Texas and Oklahoma will be achieved in the end.    Michael Bishop   Landowner Douglass, Texas"

“As a landowner in Texas, I have been fighting TransCanada Keystone in court for nearly 5 years now.  As I look at the massive Canadian tar sands pipeline projects that are bind implemented all over America, I get disgusted when I hear negative remarks about my chances of winning.  Not one lawyer would take my case and I defended myself and my land pro se.  For the record, I am the only landowner in the United States that has received an injunction against TransCanada Keystone Pipeline.  There have been millions of dollars poured into this fight by private groups, foundations but I have struggled to get  to this point by trial and error on nickels and dimes.  It is not the way to win a case against a major energy company that is pouring billions, literally, into the tar sands pipeline project.  I have witnessed a complete abandonment of landowners in this country by the electorate and corrupt judges and I think now is the time for the public to unite, rise up and stop this madness once and for all.  I want it on the record that in the end, America will be like Canada with a rise in cancer from toxic tar sands material, destruction of aquifers, waterways and permanent damage to the land we love.  The legacy we will leave for future generations is dismal.
